BOOKING TERMS & CONDITIONS

1. MAKING A BOOKING
1.1 Bookings may be made through The Net Loft website at www.netloftcornwall.net
1.2 A booking is complete once the online booking form has been completed and the deposit paid.

2. DEPOSIT
2.1 A deposit must accompany a booking.
2.2 If a booking is made one month or more before the letting is due to start you must pay a deposit of 25% of the total cost of the booking.
2.3 If a booking is made less than one month before the letting is due to start you must pay the full letting fee.

3. FINAL PAYMENT
3.1 Payment of the balance of the letting fee must be paid to The Net Loft one month before the letting is due to start (‘Due Date).
3.2 Non-payment by the Due Date may be treated as a cancellation.
3.3 The Net Loft is not responsible for sending reminders of the Due Date although we endeavour to do so.

4. CHANGING A BOOKING
4.1 Once a booking has been accepted and confirmed by The Net Loft the booking can only be changed with the written agreement of The Net Loft.
4.2 Where The Net Loft agrees to the change in the dates of letting, an administration fee of £25.00 must be paid by you.

5. CANCELLATION
5.1 If you wish to cancel the letting you most notify The Net Loft in writing (“Cancellation Notice”).
5.2 A booking may only be cancelled prior to the start of the letting.
5.3 In the event that a cancellation is made then a cancellation charge is payable depending on the number of days before the letting start date the Cancellation Notice is received by The Net Loft. The amount payable is set out in the cancellation charge table.

5.4 We will make best endeavours to re-let the cottage for the dates cancelled and if we are able to do so we will only charge you an administration fee of £25 and the cost of any shortfall that is incurred. Any money owed to you based on the conditions described in section 5 will be refunded in full.

6. DURATION AND TIMES OF LETTING
6.1 Unless agreed in writing with The Net Loft, lettings are for a maximum of 4 weeks and commence at 3.00pm on the first day of the letting and end at 10am on the day of departure unless notified otherwise.

7. YOUR OBLIGATIONS
7.1 You agree;
(a) to vacate the property by 10am on the day of departure;
(b) to pay for any losses or damages to the property, caused by you or a member of your party (reasonable wear and tear excluded);
(c) to report any significant damages or breakages to The Net Loft within 24 hours of the event;
(d) to take good care of the property and leave it in a clean and tidy condition at the end of the letting. A cleaning service is not provided during the letting unless otherwise specified or agreed, however new towels and bedding may be requested weekly for bookings for over a week. Should The Net Loft be dissatisfied with the condition of the property upon your departure, they reserve the right to refuse to take any future bookings.
(e) to permit the owners and their staff reasonable access to the property;
(f) not to part with possessions of the property, or share it, except with members of the party confirmed in the booking;
(g) not to sell or transfer the booking to another party without the written agreement of The Net Loft;
(h) not to exceed the total number of people stipulated in the booking form;
(i) not to allow gatherings or entertain at the cottage more than 6 people at the cottage
(j) not to use the cot for a child over the age of 24 months;
(k) to respect the well being of those occupants of adjoining or nearby properties and not to cause an annoyance or become a nuisance. Complaints from adjoining or nearby occupants to The Net Loft regarding your behaviour may result in The Net Loft requiring you to leave the property immediately without a refund of any monies paid by you.

8. NON-AVAILABILITY OF PROPERTY
8.1 if for any reason beyond The Net Loft owner’s control the property is not available on the date booked, or the property becomes unsuitable for holiday letting, all rent and charges paid in advance by you will be refunded in full and The Net Loft may cancel the booking.
8.2 Where possible The Net Loft will provide you with four weeks notice except in extraordinary circumstances.
8.3 If the notice period is less than four weeks The Net Loft will endeavour to find you alternative accommodation or, at your request, refund you any sums you have paid. You will have no further claim against The Net Loft.

9. PRICE CHANGES
9.1 The Net Loft has made all reasonable efforts to accurately describe the property on the website and any other published information.
9.2 The Net Loft cannot accept responsibility for errors contained in the information or any miss-description as a result of inaccurate information given to us by a third party.
9.3 You acknowledge that minor differences may arise between that information given and the actual property itself.
9.4 The Net Loft reserves the right to amend prices quoted in published information due to errors or omissions but such changes shall be notified to you as soon as possible.
9.5 You shall be at liberty to cancel the booking if the amended price is significantly higher than the original price quoted.

11 LIABILITY
11.1 The Net Loft does not accept liability for any act, neglect or default on The Net Loft part nor the part of the owners of The Net Loft or any other person not within their employ or under their control, nor for any accident, loss, costs, expenses, injury, expense or any other inconvenience or claim from compensation whatsoever, whether to person or property and whether caused by The Net Loft, its owners, employees or agents or otherwise which you or any other person may suffer or incur arising out of , or in any way connected with the letting. In addition, the owner and The Net Loft accept no liability for loss of or damage to y our possessions on the Owner’s property or land.
11.2 Nothing in these conditions excluded or limits the liability of The Net Loft and its owners:
(a) for death or personal injury caused by The Net Loft and/or its owners negligence; or
(b) under section 2(3) Consumer protection act 1987; or
(c) for any matter which it would be illegal for The Net Loft and its owners to exclude or attempt to exclude liability; or
(d) for fraudulent misrepresentation.
11.3 in all cases, except for personal injury or death, our liability to you for the total of the claim arising out of letting is limited to the cost of the booking fees less any insurance or cancellation charges.

12 PETS
12.1 One pet (or more if agreed in advance) is permitted in The Net Loft if declared before arrival and are to be kept under control and exercised off the premises.
12.2 Pets are not permitted in the bedroom or on the furniture and neither The Net Loft nor the owners can accept responsibility for their safety. Pets must not be left in the property unsupervised as this can result in considerable damage to the property and distress to the pet.
12.3 It is your responsibility to ensure your pets do not disturb those in adjoining properties, it is your responsibility to ensure that you have cleared up after your pets and that there is not trace of your pets having been at the property.

13 METHOD OF PAYMENT
13.1 Payments can be made by online by credit / debit card, by cheque (drawn from UK bank only), direct transfer or cash.
13.2 Cheques should be made payable to ‘Mr A G Lelli’. Cash should always be sent by recorded delivery post.
13.3 Post-dated cheques are not acceptable.
13.4 Any charges raised against The Net Loft and its owners for handling dishonoured cheques or any other payments will be passed on to you and you are liable to reimburse The Net Loft and its owners within seven days of receipt of notification from The Net Loft.

14 ELIGIBILITY
The Net Loft reserves the right to accept or refuse bookings in their absolute discretion.

15 THE HOLIDAY LETTING
The letting confers upon you the rightly only to occupy for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.

16 INFORMATION PUBLISHED
Some of the information published by The Net Loft relates to matters beyond the properties such as shops, restaurants and public houses. Closure of such premises and other changes to external facilities are outside The Net Loft and its owner’s control. If The Net Loft and its owners are aware of any changes to the information at the time of your booking, then they shall endeavour to inform you of these changes.

17 COMPLAINTS
17.1 All complaints must be notified to The Net Loft and its owners as soon as reasonable practicable, as The Net Loft may be required to carry out on-the-spot investigations and if necessary, carry out remedial action.
17.2 If The Net Loft or its owners were denied the opportunity of investigating the complaint within a reasonable dime or denied the opportunity to put matters right during the letting, then this may result in a reasonable reduction of any compensation payable to you arising out of such a complaint.

18. LINEN
Linen and towels are provided for you, Linen is changed between lettings and weekly during lettings.

19. BREACH OF CONTRACT
19.1 If there shall be a material breach of any of these conditions by you, the owners or The Net Loft reserve the right to re-enter the property and terminate the letting.
19.2 If there shall be a material breach of any of these conditions by The Net Loft or its owners, then you have the right to terminate the letting.
19.3 In the event that The Net Loft is unable to find someone else to occupy the property for the remainder of your stay, no refund of any sums you have paid will be returnable to you.
19.4 Termination of the letting pursuant to conditions 19.1 and 19.2 does not affect that party’s other rights and remedies.

20. GOVERNING LAW AND JURISDICTION
Any dispute between us will be governed by the exclusive law and jurisdiction of the English Courts.

21. AUTHORITY TO ACCEPT
The person who completes the booking form and therefore accepts the terms of these booking conditions confirms that:
(a) he or she is authorised to agree the booking conditions on behalf of all persons included on the booking, including those substituted or added at a later date;
(b) he or she is over 26 years of age and a member of the party intending to occupy the property; and
(c) he or she agrees to take responsibility for the party occupying the property.

22. DISCREPANCIES
22.1 In case of a discrepancy between these booking conditions and any other contents of The Net Loft conditions shall prevail.
22.2 In the vent of inconsistency between these booking conditions and any other information regarding The Net Loft, these booking conditions will prevail.

23. DATA AND PRIVACY
23.1 In making a booking we will ask for personal information such as your name, postal address, email address and telephone number. We may use the information to inform you about news and information we think may be of interest to you. Contractors will not be allowed to use your personal information for any other purpose than that which The Net Loft may have instructed. Your identity will also be made available to the owners. By booking with us you are deemed to have consented to the use of personal information for these purposes. If you decide that you would prefer that information is not used in this way or that you do not wish to receive such information, please contact us in writing or by email at andylelli@yahoo.com

24. VALIDITY CLAUSE
If any term or provision in these booking conditions is found by any court, or tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall be the extent of such illegality, invalidity, voidness or unreasonableness be deemed severable and the remaining provisions of the booking conditions and the remainder of such provision shall continue in full force and effect.
